Welcome to Brand Flow Crafts (“Company,” “we,” “us,” “our”). By engaging with our website, services, or communications, you (“Client,” “Customer,” “User”) agree to be bound by these Terms and Conditions. Continued use constitutes full acceptance of all provisions herein, whether or not explicitly read or understood.
1. Non-Refundability of Payments
All monetary transactions — including, but not limited to, booking fees, advances, partial payments, or full settlements — are final, non-refundable, and non-adjustable. Once remitted, such consideration shall be construed as unconditional acceptance of the project commencement and all associated obligations. Under no circumstances will the Company process refunds due to change of mind, dissatisfaction, project abandonment, or any similar reason.
2. Project Timeline & Client Obligations
Projects commence upon receipt of the required materials and confirmation of payment. Clients are obligated to provide complete content (text, imagery, logo, credentials, or related assets) within 48 hours from the initiation of engagement.
The Company endeavors to deliver the complete website or digital project within three (3) working days of content submission.
Should content not be furnished within this period, a late-fee assessment of ₹1,000 (INR) per day per project will automatically apply beginning the fourth (4th) day, irrespective of cause, until such content is duly received. The Company shall not be liable for delays occasioned by the Client’s failure to provide timely input.
If the delay arises from the Company’s internal factors, no additional fees shall be levied.
3. Project Cancellation & Abandonment
Upon commencement, the project is deemed irrevocable. Should the Client elect to terminate or cancel the project at any stage, the entire project amount shall remain payable. Deliverables, digital assets, or access credentials shall be withheld until the total outstanding amount is settled in full. No exceptions shall apply.
4. Content Usage & Intellectual Property
All demonstration material (text, media, or design elements) utilized during project development is sourced from publicly available or free repositories solely for illustrative purposes. The Company disclaims any liability for potential copyright infringements. The Client assumes full responsibility for replacing or updating such content post-delivery.
The intellectual property of the Brand Flow Crafts trademark, logo, and design identity is protected and may not be used without express written authorization.
5. Post-Delivery Responsibilities
Following deployment, publication, or handover of the project, the Company bears no continuing obligation for maintenance, technical discrepancies, or external damages (including hosting outages, third-party plugin conflicts, or expired credentials). Any subsequent modifications, updates, or enhancements shall be billed per prevailing Company pricing.
6. Testimonials & Media Usage
Video reviews, testimonials, or other promotional material voluntarily shared by the Client become the property of the Company for perpetual marketing use across any medium, including digital and print, under the Brand Flow Crafts identity.
7. Domain & Hosting Procurement
Where domain names or hosting plans are purchased through the Company, such services are sourced from independent third-party vendors. The Company reserves the right to apply administrative or handling charges above vendor pricing. Subsequent objections or disputes regarding pricing shall be null and void. Renewals, migrations, or upgrades are subject to separate fees.
8. Data Privacy & Confidentiality
Client information and data shared for project execution are maintained solely for operational purposes. The Company accepts no liability for post-delivery data breaches, unauthorized access, or cyber incidents arising beyond its direct control. Clients are advised to update all credentials upon delivery to mitigate risk exposure.
9. Limitation of Liability
Under no circumstances shall Brand Flow Crafts, its owners, employees, or affiliates be liable for any indirect, incidental, consequential, or punitive damages arising from the use or inability to use the delivered product, service, or website.
10. Governing Law & Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of India. All disputes shall fall exclusively within the jurisdiction of the courts located in New Delhi, India.
11. Acceptance of Terms
By remitting payment, signing a quotation, or continuing engagement with the Company, the Client explicitly acknowledges having read, comprehended, and accepted all stipulations contained herein.
